On January 17, 2025, the Federal Trade Commision filed a complaint against Cognosphere, LLC, the maker of Genshin Impact, alleging, among other things, that Genshin Impact engaged in unfair and deceptive business practices with regards to the pricing of its in-game loot boxes (“Wishes”).

Specifically, the game advertises a “huge drop-rate boost” for 5-star heroes during Event Banners, yet the actual odds are 0.3% per loot box. Additionally, the complex in-game exchange system (dollars to Genesis Crystals to Primogems to Wish tokens) obscures costs, requiring up to 180 loot boxes ($360-$540) for a featured prize. Finally, there is no age-gating feature for purchasing loot boxes, allowing teens and children to spend up to $99 at a time.

The Complaint further alleges that Cognosphere paid influencers to promote these loot boxes to children and intentionally obscure the actual odds of winning.

THE CLAIM

This claim alleges Genshin Impact engaged in deceptive and unfair business practices regarding the odds and pricing of its in-game loot boxes, in violation of California unfair competition laws. If you live in California, played Genshin Impact and purchased one or more loot boxes (“Wishes”), you may qualify for a claim under state law and reimbursement of any money spent.

ARBITRATION

Unlike a class action, in arbitration your claim is your own. Consumers who pursue arbitration have more control over the outcome of their claim than consumers who join class actions involving similar claims.
