What Do I Do if I was Injured by a Dangerous Condition?

Here are a few tips to try and remember if you are ever injured by a dangerous condition in a public place such as a grocery store or other retailer.

(1) Try to Write Down the Names and Numbers of All Employees

Sometimes you may know the names of the employees on duty because you visit that store often. Other times, it may just be looking at their name tags if they interact with you and trying to remember what they said.

 

(2) Try to Write Down the Names and Numbers of All Witnesses

If anyone around you saw the incident or saw the dangerous condition you should get their name and number. The statement of an independent witness in your favor who saw what happened will strengthen your case.

 

(3) Demand a Copy of the Incident Report

Try not to leave the store (or scene of incident) without first demanding a copy of the incident report. Many times, the store manager will try to deny you a copy of the incident report — insist that they provide you with a copy that includes:

  • The date and time of the incident
  • The address and store location
  • The names of the manager on duty and any involved employees
  • A correct description of your version of events

(4) Take Photos of the Dangerous Condition

If possible, take photos of the dangerous condition. If the dangerous condition is no longer there, take photos of the exact scene of the incident and then describe how the dangerous condition occurred. This will help your attorney understand what happened.

(5) Go to Emergency Room / Urgent Care

Do not hesitate to go get care. If you have been injured by a dangerous condition, go to local urgent care or emergency room to get checked out. Regardless of what effect this has on your case, your health and recovery should always come first.
